1. Acceptance of Terms

By downloading, installing, or using the Radiate mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Kratos Studios Limited ("we," "our," or "us"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Radiate is an AI-powered skincare assistant that helps users analyze their skin health, scan product ingredients, track skin progress through selfies, and receive personalized skincare reminders. The App uses artificial intelligence to provide skin analysis across multiple metrics including hydration, texture, acne, brightness, elasticity, pores, dark spots, and wrinkles.

3. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the App.

4. Account and Authentication

The App may create an anonymous account for you upon first use. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Subscriptions and Payments

• Free Tier: The App offers limited free access to certain features.
• Premium Plans: Premium subscriptions (weekly, monthly, or yearly) unlock full access to all features. Subscriptions are billed through Apple App Store or Google Play Store.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your device's app store settings. No refunds will be provided for the current billing period upon cancellation.
• Price Changes: We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle.

6. Health and Medical Disclaimer

• Skin analysis results are generated by AI and may not be accurate or complete.
• Do not use the App as a substitute for professional dermatological advice, diagnosis, or treatment.
• Always consult a qualified healthcare professional for skin concerns, conditions, or before making changes to your skincare routine.
• Product ingredient analyses are AI-generated and should not be solely relied upon for allergy or sensitivity decisions.
• We are not responsible for any adverse reactions or skin conditions resulting from actions taken based on the App's suggestions.

7. Acceptable Use

You agree not to use the App to:

• Upload images that are illegal, obscene, or violate the rights of others
• Attempt to bypass usage restrictions or security measures
• Reverse engineer, decompile, or disassemble the App
• Use automated scripts, bots, or other means to access the App
• Use the App to develop competing products or services
• Interfere with or disrupt the App's infrastructure or other users' experience
• Upload images of individuals without their consent

8. User Content and Photos

Your Photos: You retain ownership of all selfies and product images you upload. By using the App, you grant us a limited, non-exclusive license to process your photos as necessary to provide skin analysis and product scanning features.

Storage: Your photos are stored securely in cloud storage to enable progress tracking. You may delete your account and associated data at any time.

Skin Profile Data: Information you provide about your skin type, concerns, and goals is used solely to personalize your experience within the App.

9. Intellectual Property

The App, including its design, features, code, and branding, is owned by Kratos Studios Limited and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any AI-generated skin analyses, ingredient assessments, or recommendations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KRATOS STUDIOS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kratos Studios Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification shall survive termination.

14. Changes to Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the courts of competent jurisdiction.
